1) Acceptance of Terms

By creating an account, purchasing credits, booking a session, or otherwise using SabaiFit (the "Services"), you agree to these Terms, our Privacy/PDPA Policy, Cookie Policy, and any rules or policies referenced here (collectively, the "Policies"). If you do not agree, do not use the Services.

2) What SabaiFit Is

SabaiFit is a marketplace connecting customers ("Customer", "you") with independent personal trainers ("Trainers") for in-person sessions in Bangkok and surrounding areas. SabaiFit does not employ Trainers and does not provide training services itself.

3) Eligibility & Accounts

  • You must be 18+ to use the Services.
  • Provide accurate information and keep it current.
  • You are responsible for securing your account credentials and all activity on your account.

4) Wallet & Credits

  • Credits = THB: Sessions are paid in credits (1 credit ≈ 1 THB).
  • Purchases: Buy credits via supported methods (e.g., Stripe Checkout). Bank/FX fees may apply.
  • Use: Credits are used for session charges, adjustments, and refunds.
  • No Cash-Out: Credits are not legal tender and are non-withdrawable, except if required by law or if we explicitly offer a withdrawal feature.

5) Prices, Taxes, and Currency

Trainer rates are displayed in credits and include applicable taxes unless stated otherwise. We may show estimated THB equivalents for convenience.

6) Booking Process

  • Request: Choose a Trainer, time, and location to request a session.
  • Confirmation: A booking is confirmed only when the Trainer accepts in-app. Until then, slots are not guaranteed.
  • Charge Timing: Credits are deducted on acceptance of your request.
  • Completion: Trainers mark sessions complete. If not marked, a session may auto-complete 3 hours after the scheduled end.

7) Cancellations & Refunds

Your refund depends on the time remaining to the session start (Asia/Bangkok time):

  • More than 12 hours: 100% credits returned to your wallet.
  • 2 to 12 hours: 50% credits returned.
  • Less than 2 hours or no-show: 0% returned.

If a Trainer cancels, you receive a 100% credit refund. Rescheduling is treated as a cancel + new booking unless the Trainer agrees otherwise in-app. All movements appear in your wallet ledger.

8) Disputes & Adjustments

If something goes wrong, contact support in-app or at support@sabaifit.com within 7 days of the session. We may, at our discretion, issue partial credits, deny a claim, or facilitate a re-session consistent with our Policies. Adjustments are posted transparently to your ledger.

9) Conduct, Safety & Health

  • Be respectful and on time. Provide a suitable, safe space (condo gym with permission, private gym, or other safe location).
  • Consult a medical professional before starting any exercise program. You acknowledge that fitness activities carry inherent risks.
  • We may suspend accounts for unsafe behavior, harassment, fraud, or policy violations.

10) Trainers Are Independent Contractors

Trainers set their own methods and are not employees or agents of SabaiFit. We verify credentials where practical but do not guarantee outcomes, specific results, or trainer availability.

11) Ratings & Reviews

You may rate and review sessions for 14 days after completion. You grant SabaiFit a license to display, reproduce, and moderate your review content to maintain marketplace quality.

12) Payments, Chargebacks & Errors

  • We use third-party processors to handle payments (see Sub-processors page).
  • In case of chargebacks, suspected fraud, or errors, we may reverse or offset credits in your wallet and/or pause bookings pending review.
  • Pricing errors may be corrected with notice and appropriate credit adjustments.

13) Third-Party Services

Some features (payments, hosting, push notifications, analytics) are provided by third parties under their terms. See our Sub-processors page for current providers.

14) Privacy (PDPA)

We process personal data under the Thai PDPA. See our Privacy/PDPA Policy for what we collect, why, retention, transfers, and your rights (access, correction, deletion, objection, portability, consent withdrawal). Contact: privacy@sabaifit.com.

15) Cookies & Tracking

Our Cookie Policy explains how we use cookies/SDKs. Non-essential cookies are off unless you consent; you can change preferences anytime.

16) Intellectual Property

The Services and content we provide are protected by IP laws. You may not copy, modify, or distribute the platform except as permitted by law or our Policies.

17) Suspension & Termination

We may suspend or terminate your account for policy violations, non-payment, fraud, or safety concerns. You may close your account in-app. We may cancel upcoming sessions and refund per these Terms.

18) Warranties & Disclaimers

The Services are provided "as is" and "as available." We make no warranties regarding trainer availability, outcomes, or uninterrupted access.

19) Limitation of Liability

To the extent permitted by law, SabaiFit's total liability for claims arising out of or relating to the Services will not exceed the greater of: THB 10,000 or the total amount you paid to SabaiFit in the 12 months preceding the claim. Nothing limits liability that cannot be limited by law.

20) Indemnity

You agree to indemnify SabaiFit from claims arising from your misuse of the Services, breach of these Terms, or violation of law.

21) Changes to These Terms

We may update these Terms. Material changes will be notified in-app or by email and will include an effective date. Continued use after the effective date constitutes acceptance.

22) Governing Law & Jurisdiction

These Terms are governed by the laws of the Kingdom of Thailand. The courts of Bangkok shall have exclusive jurisdiction, subject to any mandatory consumer protections.

Annex A — Refund Policy (Quick Reference)

  • Cancel >12h before: 100% credits back.
  • Cancel 2–12h before: 50% credits back.
  • Cancel <2h or no-show: 0% back.
  • Trainer cancels: 100% credits back to you.

By accepting these terms, you acknowledge that you have read, understood, and agree to be bound by these terms. These terms supersede all previous agreements between the parties.
